Content Policy

This Acceptable Ad Creative and Content Policy (the “Policy”) describes the types of prohibited and restricted content and creative when providing Synaptic Intelligence with Ad Creatives for display and serving via the System.
All capitalized terms not otherwise defined hereunder shall have the meaning ascribed to them in the Services Terms and conditions available at https://synaptic-ai.com/terms-and-conditions.
Customer hereby agrees and undertakes to comply with the terms and conditions of this Policy. If Synaptic Intelligence suspects that an Ad Creative is in violation of any of the terms and conditions of this Policy, Synaptic Intelligence reserves the right to: (i) stop the specific Ad from running and being displayed; (ii) block certain creative, landing pages, or content; and/or (iii) disable Customer’s account in the event of multiple or severe violations of this Policy, all at Synaptic Intelligence´s sole and absolute discretion.
Synaptic Intelligence reserves the right to modify, amend and update this Policy or any part thereof at any time, in its sole discretion.
Reference is made hereunder to the IAB’s (Interactive Advertising Bureau) contextual taxonomy categorization.

  1. General usage rules

In addition to, and without derogating from, the terms and conditions set forth in the Service Terms and Conditions, Customer shall not use the System in any way that causes, or may cause, damage to the System and/or Hosted Services or impairment of the availability or accessibility of the System or the Hosted Services.
Customer must not use the System and/or Hosted Services: (i) in any way that is unlawful, illegal, fraudulent or harmful; (ii) or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.
Customer must ensure that all content complies with the provisions of this Policy.

  1. Unlawful and Prohibited Content

2.1. Content, and the use of content by Synaptic Intelligence in any manner licensed or otherwise authorised by Customer, must not: (i) be libellous or maliciously false; (ii) be obscene or indecent; (iii) infringe any copyright, moral right, database right, trade mark right, design right, right in passing off, or other intellectual property right; (iv) infringe any right of confidence, right of privacy or right under data protection legislation; (v) constitute negligent advice or contain any negligent statement; (vi) constitute an incitement to commit a crime, instructions for the commission of a crime or the promotion of criminal activity; (vii) be in contempt of any court, or in breach of any court order; (viii) constitute a breach of racial or religious hatred or discrimination legislation; (ix) be blasphemous; (x) constitute a breach of official secrets legislation; or (xi) constitute a breach of any contractual obligation owed to any person.
2.2. Customer undertakes to ensure that content is not and has never been the subject of any threatened or actual legal proceedings or other similar complaint.
2.3. Customer shall not serve Ad Creatives which contain or promote the following content:
2.3.1. Adult sexual content
2.3.2. Copyrighted materials
2.3.3. Counterfeit goods
2.3.4. Drugs and drug paraphernalia
2.3.5. Endangered species products
2.3.6. Hate content, sensitive topics and violence
2.3.7. Illegal products and services:
2.3.8. Incentivized clicks and downloads
2.3.9. Spyware and illegal hacking
2.3.10. Unauthorized ticket sales
2.3.11. Weapons and weapons accessories

  1. Graphic material

3.1. Content must be appropriate for all persons who have access to or are likely to access the Ad in question, and in particular for children over the age of 13 years.
3.2. Content must not depict violence in an explicit, graphic or gratuitous manner.

  1. Factual accuracy

4.1. Content must not be untrue, false, inaccurate, misleading, or of low editorial quality. The content must be clear, accurate and of high editorial quality.
4.2. Statements of fact contained in the Ad Creative content and relating to persons (legal or natural) must be true; and statements of opinion contained in Ad creative content and relating to persons (legal or natural) must be reasonable, be honestly held and indicate the basis of the opinion.

  1. Negligent advice

5.1. The content shall not include any legal, financial, investment, taxation, accountancy, medical or other professional advice, and the Customer may not use the System and/or the Hosted Services to provide any legal, financial, investment, taxation, accountancy, medical or other professional advisory services.
5.2. Content shall not include or involve any advice, instructions or other information that may be acted upon and could, if acted upon, cause death, illness or personal injury, damage to property, or any other loss or damage.

  1. Etiquette

6.1. Content must be appropriate, civil and tasteful, and comply with generally accepted standards of etiquette and behaviour on the internet.
6.2. Content must not be offensive, deceptive, threatening, abusive, harassing, menacing, hateful, discriminatory or inflammatory.
6.3. Content must not be liable to cause annoyance, inconvenience or anxiety.
6.4. The Customer shall not use the System and/or the Hosted Services to insult or offend others or to send any hostile communication or any communication intended to insult or offend, including such communications directed at a particular person or group of people.
6.5. The Customer shall not duplicate other content available through the System.
6.6. The Customer should use appropriate and informative titles for all content.

  1. Marketing and spam

The Customer shall comply with the CAN-SPAM Act, 2003 and any and all applicable laws, rules and regulations in connection with commercial advertisements.

  1. Gambling

Customers may run Ads that contain the following content, or that promote the following categories of products and services, only after obtaining Synaptic Intelligence’s prior written consent: lotteries content, gambling, gaming and betting content, political campaigning, tobacco and tobacco accessories:

  1. Data mining

The Customer shall not conduct any systematic or automated data scraping, data mining, data extraction or data harvesting, or other systematic or automated data collection activity, by means of or in relation to the System and/or the Hosted Services.

  1. Hyperlinks

The Customer shall not link to any material using or by means of the System and/or the Hosted Services that would, if it were made available through the System and/or the Hosted Services, breach the provisions of this Policy.
